    Another thing to remember is if somehow you ended up being interrogated by the police (voluntarily) at their station and you decide to be silent. Explicitly state that you are pleading the fifth amendment. This is because sometimes if you just stay silent without saying that, they may try (in court) to say that you chose not to say anything out of guilt. Or you can just not voluntarily go to the station for an interview if you do not have an attorney

    Is this not a joke? You really need to know this, as a law-abiding citizen, living in USA? I’m from Norway, and this feels, well, literally foreign to me. Are there countries in Europe where this type of advice is applicable?

    I've had only good experiences with talking to cops. Never been arrested. Have had cops after me about 30 times for dirving infractions, DUI suspicions, hit and run etc. Never paid a dime for a lawyer and never wasted any time at the cop shop insisting on a lawyer.

    This is great but sadly cops can just shoot you or Arrest you for nothing. It really sucks and is horrible what they get away with. And you don't need to give info in all states so that's a lie.

    There's a critical point she glosses overs. In a court case, third-party statement are generally not allowed; it's called hearsay. (Hearsay is technically any statement not made in court.) If anyone gets on the stand -- including a cop -- and testifies "I heard person X say ...", such testimony can be thrown out (or not allowed in) as hearsay. However, there are several exceptions to the hearsay rule,. One such exception is the "admission of party opponent", which includes self-incriminating statements. So a cop can (and will) be called to testify to any incriminatory statements made by a defendant, but cannot testify to any exculpatory statements, because the latter are expressly forbidden as hearsay. This isn't the cop being a jerk, this is just how the law works. Thus the Miranda warning, "anything you say can and will be used against you". Disclaimer, I am NOT a lawyer, and I've never actually heard a lawyer explain this. Her statement (about the 0:55 mark) of "kinda skating the razors edge of ethics by talking about it" makes me wonder what ethics violation she is skating. Explaining how the law works is unethical?

    This video is somewhat older now, but an important point. Depending on the situation, it may not be enough to simply stay silent. It is best to directly, unequivocally and unambiguously state your invocation of the fifth amendment. Ditto for requesting a lawyer -- something like "should I get a lawyer?" or "do I need a lawyer?" are insufficient. Clearly state "I want a lawyer". (Note: I am NOT a lawyer.)

      I agree, interrogating officers are well known for using verbal strategies. So saying "I want a lawyer" could be purposefully misinterpreted by police as not asking for a lawyer - you're just telling the officer that you want a lawyer. However, saying something like "I am requesting to speak to my attorney" is more direct and probably less able to be misinterpreted

    Retired leo here. Shut up! Do not agree to talk. Do not consent to search of your person, home, car. Do not agree to provide finger prints, handwriting samples, documents, etc. If they have probable cause, they will proceed without your consent. Don't obstruct or hinder. They are in charge at the moment. Let them have control. Everything is now video recorded. Show that future jury, and the media your controlled demeanor, courteous speech, respectful tone and assertion of your constitutional rights. Let the cops appear heavy handed and oppressive in their demeanor.

    If you are being questioned by police, the only things you MUST LEGALLY speak aloud is "I am invoking my 5th amendment right to remain silent and I would like to speak with my attorney". If you are still arrested for "obstruction", do not resist, remember you will be earning potential money sitting in jail wrongfully. You are NOT obligated to be a witness against yourself.

    She’s so right when she said that confessions from the innocent and the guilty sound exactly the same, obviously everyone speaks and conveys their story differently but the reason they sound the same is because the tactics law enforcement use to get confessions are very clever and cunning and they essentially “walk” people into confessing and not always but many times they don’t quite realize they’ve confessed or given enough information to be prosecuted until it’s too late and sometimes not at all AND sometimes they’ve even convinced themselves that what they said is going to help their case and vindicate them

    The problem isn't the cops. They are just people following their orders. The problem isn't their bosses, they are just people following their orders. The problem is the orders. The laws. There are too many laws, they are not understood by the people they are meant to protect. Their volume and complexity benefit only lawyers, politicians and special interests. Like she says, these days everyone is guilty of at least something - there are so many things to be guilty of now it's impossible not to be. And because of this we lose respect for the law even more and society becomes more lawless in aggregate. So do us all a favor. Vote for politicians who will reduce the size and power of government that creates all these laws. Vote for a deregulator. Vote for giving people the right to defend their communities and manage them more autonomously with less of the intrusive abusive powers above.

    4:15 "DO what ordered to do". "Ordered to do something, Then DO it." << 'Do'?? "Unconditional" - as "Trick" re: 'field sobriety test' - (as noted: "Never mandatory"). So, if One Knows this test is NOT Mandatory, WHY "Do" it? - thrown out later, BUT? "Tricks" should Never be a part of process. Tricks lends Thought One has power, then the people must fight against Unconstitutional Tyrants that *are to be Our servants.* *TRUTH spoken about 'processes'* should *Never be hidden* nor Denied.
